- Deliveroo Australia Pty Ltd v Diego Franco [2022] FWCFC 156 – the Fair Work Commission has applied the principles set down in CFMMEU v Personnel Contracting and ZG Operations Australia v Jamsek (the High Court decisions) in deciding that a Deliveroo driver was an independent contractor and not an employee. This is the latest and most significant decision in the employee vs. contractor landscape for the gig economy. We will discuss how the decision provides a roadmap in applying the High Court decisions to client situations.
- Section 100A – On 19 September 2022, the Federal Court handed down the latest section 100A decision in BBlood Enterprises Pty Ltd v Commissioner of Taxation [2022] FCA 1112. The ATO is also seeking consultation on five (5) additional examples to include in the ‘green zone’ set out in its Practical Compliance Guideline PCG 2022/D1. What is the current state of play with section 100A? Should these developments change your plan in defending against section 100A risks in family trust arrangements?
