  • FCT v Carter [2022] HCA 10 – When are trust disclaimers valid for tax purposes? What should you be aware of when helping clients to disclaim their beneficial interests to income and/or capital entitlements of a trust (for example, in a divorce settlement)?
  • Re Permewan No. 2 [2022] QSC 114 – Gift and Loan Back arrangements are a common asset protection strategy for individuals with high creditor and claim risks.  The Supreme Court of Queensland had shot down an example of this arrangement.  Do they still have a place in the asset protection arsenal?
  • Hill v Zuda [2022] HCA 22 – Many advisers and members of SMSFs have eagerly waited for this decision.  Is it a new era for Binding Death Benefit Nominations (BDBNs)?
